On March 26, 2014, Anthony Dominguez-Cano was a passenger in a vehicle that was being pursued by Winnebago County sheriff deputy James Abate.
Abate at the time had been a sheriff's deputy for five years working on the SWAT team.
It’s been alleged that Abate was pursuing this vehicle under the belief that one of the occupants might have been involved in a disorderly conduct investigation.
Disorderly conduct is a Class C misdemeanor punishable by up to 30 days in the county jail.
Another occupant in the vehicle was wanted on a bench warrant for criminal trespassing charges.
Someone from the vehicle shot in the direction of Abate.
Anthony and the other individual ran from the scene while being chased by Abate.
He was shot twice, once in the back and once in the leg as he was running away.
The individual that was wanted was able to get away that night.
